The truck driver allegedly responsible for Tracy Morgan’s fatal limo crash is seeking a dismissal of the criminal charges against him on the grounds that he can’t get a fair trial.

As Gossip Cop reported, Walmart truck driver Kevin Roper slammed into Morgan’s limo bus on the New Jersey turnpike in June 2014. Morgan and other passengers were critically injured, and his friend and fellow comedian James McNair was killed. Roper, who was said to have been awake for more than 24 hours at the time of the crash, was arrested for assault by auto (four counts) and death by auto (one count).

But in the wake of media attention surrounding Morgan’s recovery, and the news that he settled a lawsuit against Walmart, Roper’s legal team has filed documents claiming it would be impossible for him to get a fair trial. His camp specifically points to Walmart taking responsibility for the incident as evidence that he’s already been convicted in the public eye, as well as to comments made from Morgan’s own lawyer and the National Transportation Safety Board. Roper has already pled not guilty to the charges, and now wants the entire case dismissed, reports TMZ.

As Gossip Cop reported, Morgan’s settlement with Walmart was announced in May. While the terms were kept confidential, it’s been claimed he was paid as much as $90 million for pain and suffering. And though he’s spoken about the devastation of the ordeal, he has not specifically commented on Roper’s pending criminal charges. The new development in the case comes just two weeks after Morgan wed Megan Wollover and miraculously walked down the aisle despite his injuries.
