Tracy Morgan Sues Walmart For Negligence In Crash The Injured Him, Killed Comic Pal
As you’ll recall, Wal-Mart driver Kevin Roper had allegedly been awake for more than 24 hours leading up to the accident when he reportedly fell asleep at the wheel and plowed into Morgan’s limousine van on the New Jersey Turnpike.
According to papers filed in the U.S. District Court in New Jersey on behalf of Morgan, McNair’s widow, and comedian Ardie Fuqua and Morgan’s assistant Jeffrey Millea, who were also injured in the crash, “Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries.”
“As a direct and proximate result of said collision,” notes the compliant, “Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”
The suit further alleges that “Wal-Mart knew, or should have known” that Roper, who was later charged in the multi-vehicle crash, was “awake for more than 24 consecutive hours” before the collision.
Morgan is currently in a rehab center, where he’s showing “signs of improvement.”
Wal-Mart said in a statement, “We are deeply sorry that one of our trucks was involved,” adding, “We’re committed to doing the right thing for all involved.”
