“Hannah Montana” star Mitchel Musso has been charged with drunk driving and could potentially go to jail.

The 20-year-old actor, who played Oliver Oken on the hit Miley Cyrus series, was busted last weekend in Burbank, California after failing to stop for police and then flunking a sobriety test.

He’s now facing two misdemeanor DUI charges.

Musso is due in court on November 11.

If he’s convicted, Musso could be hit with a maximum penalty of six months in jail and a $1,000 fine.

Mitchel Musso, who played Oliver Oken on “Hannah Montana,” was busted for drunk driving on Sunday morning in Burbank, California, Gossip Cop has confirmed.

The 20-year-old’s Mercedes was pulled over when he failed to come to a stop for police, who were directing traffic because of an accident.

Musso was then given a sobriety test, which the underaged actor failed.

We’re told he also took a breathalyzer test, and blew “well over” a .08, which is the legal limit (for those old enough to drink).

The Disney star was taken to a local jail and booked on suspicion of DUI.

Cyrus has created a new account, @gypsyhearttour, to keep fans informed about her upcoming world tour, her rep confirms to Gossip Cop.

The singer-actress, who tweeted that she wants to “get back to as many followers as before [1.1 million],” explains she rejoined Twitter “for 2 reasons. My fans and to follow @charliesheen #winning.”

The former “Hannah Montana” star quit the social networking site in October 2009.

“Miley Cyrus Disses Rebecca Black & Bieber,” blares yet another wildly inaccurate HollywoodLife headline.

According to the blog, “Cyrus seems to be having some trouble dealing with her decreased popularity following the end of Hannah Montana, and [she's] taking it out on Rebecca Black!”

HollywoodLife quotes Australia’s Daily Telegraph, in which Cyrus said, “It should be harder to be an artist. You shouldn’t just be able to put a song on YouTube and go out on tour.”

Then the site notes, “Miley seems to forget however that there is one major star who got his big break of YouTube — Justin Bieber! Justin’s videos were what first caught the attention of record labels, and there seem to be more and more young stars just like him these days!”

That’s a genuinely excellent point.

Now let’s return from HollywoodLife’s fantasy land to the realm of reality.

For starters, Cyrus NEVER called out – or even mentioned – Rebecca Black.

Cyrus didn’t “take it out” on Black. HollywoodLife did.

Nor did Cyrus “forget” Bieber.

In fact, a source close to Cyrus – and privvy to the full interview with the Daily Telegraph - tells Gossip Cop the star’s comment was a direct response to a question about YouTube sensations like Justin Bieber.

Our insider tells us, “Miley said Justin was a friend” and “talked about how hard he’s worked” to make it ever since his music was posted on YouTube.

In other words, Cyrus slammed neither Black nor Bieber, despite HollywoodLife’s misleading headline.

Miley Cyrus joined her parents Billy Ray and Tish along with little sister Noah for a family outing yesterday in Los Angeles.

The Cyrus clan looked like one big happy family as they picked up some java at Coffee Bean in Toluca Lake, California.

This is the first time Miley has been seen publicly with her father since he spoke to GQ about her in February, in an interview where he blamed “Hannah Montana” for destroying his family.

Billy Ray recently withdrew his petition to divorce Tish, saying on “The View,” “I want to put my family back together.”

In the same interview, he described his relationship with his superstar daughter as “the best it’s ever been.”

Miley Cyrus‘ parents may be getting back together.

During an interview for “The View” scheduled to air tomorrow, Billy Ray Cyrus reveals to the hosts, “I’ve dropped the divorce.”

“I want to put my family back together,” adds Cyrus.

When asked how things are between him and Tish Cyrus now, Billy Ray says, “I think for the first time me and my entire family are finally communicating with each other in a way that [it hasn't been] for quite some time, and to answer your question, things are really the best they’ve ever been.”

His relationship with Miley seems to be especially strong these days.

“The best it’s ever been. I feel like I kind of got my Miley back in a way. I feel like we are the daddy and the daughter that we were before ‘Hannah Montana’ happened. Our communication, we have laughed a lot in the last couple of days.”

The famous father also clears up some heated comments he made to GQ magazine, in which he declared “Hannah Montana” “destroyed my family.”

On “The View,” Cyrus sets the record straight.

“I don’t think ‘Hannah Montana’ ruined my family,” he says. “I love ‘Hannah Montana.’ I love Disney. That didn’t tear my family apart. Now fame, fame is a different animal. You’ve got to be careful with that thing.”

Billy Ray and Tish Cyrus announced that they’d filed for divorce in a joint statement last October.

“MILEY SNAPS!” blares a headline in Star magazine, which claims that Miley Cyrus has hit a “breaking point” due to “months of stress and heartbreak.”

The mag cites Cyrus’ run-ins with paparazzi on March 8 and 9, claiming that she “angrily lashed out at photographers, even throwing punches at one!”

According to a supposed “source” for the tabloid, the former Disney star’s so-called “violent outbursts” are due to the “mounting stress in her life” such as “her waning career and boy troubles.”

“Miley’s in a funk because she doesn’t feel she’s getting as much attention as when she was Hannah Montana,” says another “insider.”

Hmm…

If Cyrus was seeking attention, why would she be fending off the paparazzi?

She wouldn’t.

The mag adds that “failed flings with John Mayer and Josh Bowman” also had to do with Cyrus’ “meltdowns.”

Now this argument could be more believable than the “waning career” theory (Cyrus has two movies coming out this year), but Cyrus NEVER dated Mayer nor was she ever involved with Bowman.

Double oops.

Oh, and one more thing: the former “Hannah Montana” star did NOT “throw punches” at a photographer. Gossip Cop has video footage of Cyrus’ recent encounter with the paps, and anyone can see the young star is simply trying to protect her privacy – and her mom.

Billy Ray Cyrus says he deeply regrets letting Miley star on “Hannah Montana.”

“It destroyed my family. I’ll tell you right now – the damn show destroyed my family,” the country singer tells GQ in an explosive interview.

Cyrus, who earlier this year filed for divorce from Tish, his wife of 13 years, says he wishes the show had never happened.

“I’d take it back in a second. For my family to be here and just be everybody okay, safe and sound and happy and normal, would have been fantastic,” he laments.

“I was going to work every single day knowing that my family had fallen apart, but yet I had to sit in front of that camera,” adds Cyrus, who also starred on the hit series.

He says he took the blame for Miley’s scandals, such as the infamous bong incident and the racy Vanity Fair photo shoot, “because I’m her daddy, and that’s what daddies do,” but he confesses he’s now “scared” for his daughter.

“She’s got a lot of people around her that’s putting her in a great deal of danger,” says the “Achy Breaky Heart” singer, who was unhappy she held 18th birthday at a bar.

“I should have said, ‘Enough is enough – it’s getting dangerous and somebody’s going to get hurt’ . . . Honestly, I didn’t know the ball was out of bounds until it was way up in the stands somewhere.”

Today, a number of sites, including OceanUp and The True Gossip, ran an interview Miley Cyrus gave to College Cures.

In the “interview,” Cyrus allegedly had a few not so complimentary thoughts about “Gossip Girl” star Taylor Momsen.

When Cyrus was asked what she had in common with Momsen, the former “Hannah Montana” star replied, “The only thing we have in common is our love for music, singing and acting.”

And as for whether the “press has turned a blind eye to Taylor and focused their attention” on Cyrus, the So Undercover lead felt Momsen got a little bit of a break, and explained, ”My fan base has always been a younger audience than hers, but people seem to forget the fact that she’s younger than me; she’s on Gossip Girl, younger people watch that too! Just because I worked for the Disney Channel doesn’t mean that I’m not allowed to grow up and Taylor is. She’s seventeen years old. She has young people watching her, too.”

Of course, there’s one slight – no, BIG – problem with the interview.

Cyrus NEVER gave this interview, a point College Cures later apologetically acknowledged, though inexplicably OceanUp and the ironically titled The True Gossip have yet to rectify.

Once again, this “interview” is as FAKE as the supposed topless cell phone shot of Cyrus.

The series finale of “Hannah Montana” on Sunday was seen by 6.2 million viewers, leading to a Disney Channel ratings record.

“Hannah Montana Forever,” Miley Cyrus‘ swan song as her iconic character, was cable’s top telecast among children and tweens for the hour, and it was Disney’s highest ratings ever in total viewers in that time slot.

The show’s fourth season was the series’ most-watched in total viewers, and it recaptured the ranking of No. 1 cable series among kids 6-11 and tweens 9-14, which it previously held in 2006 and 2007.

The man who allegedly hacked into Miley Cyrus‘ e-mail and MySpace accounts has been arrested on other charges.

Josh Holly was busted in Nashville for possession of unauthorized credit card account numbers after FBI agents seized his computer.

According to an affidavit, Holly admitted to hacking into Cyrus’ MySpace account. Previously, he’d allegedly bragged about infiltrating the pop star’s Gmail account and swiping private photos of her.

He has since been released from custody.

There are not yet charges against Holly pertaining to Cyrus.

Last month, a purportedly stolen iPhone “nude” photo of the “Hannah Montana” star was proven to be fake.

After a year marked by controversies and family drama, Miley Cyrus sent her fans a message of Christmas cheer.

The “Hannah Montana” star celebrated the holiday in Nashville with her loved ones.

She and little sis Noah Cyrus sang a duet of “Can’t Be Tamed” on Noah’s new karaoke machine, and the two were busy coloring when Miley made a quick video expressing her Christmas and New Year’s wishes.

“I want to make [2011] the year that I go out and do what I’m here to do, and that’s to help people and make people happy,” says Cyrus.

A day after Kelly Osbourne verbally supported her So Undercover costar and new pal Miley Cyrus, the reality star is now visually showing her support.

Last night, Osbourne tweeted a photo of herself with Cyrus, donning a light brown wig to match the “Hanna Montana” star’s hair. Underneath the photo of the two similar looking friends flashing the peace sign, it read, “I’m just being Miley!!!!”

Just two days ago, Osbourne blasted a National Enquirer story titled, “Miley A Bad Influence On Kelly O,” which claimed “Cyrus’ hard-partying lifestyle is rubbing off on her new BFF Kelly Osbourne – and friends fear the Disney dynamo will push the reality star into a terrible drug relapse.”

Osbourne angrily tweeted, “Actually it’s the other way around Miley has us all on a health kick. Gym/early nights.”

She added, “Miley is one of the most hard working respectful women I have ever worked with I am learning a lot from her… she mad (sic) one mistake and trust me she has learned her lesson!”

“Shake It Up,” a new series starring Bella Thorne, premiered last night as the Disney Channel‘s top Sunday series debut ever.

It didn’t hurt that its “Hannah Montana Forever” lead-in had its best ratings in three years.

But with “Hannah” star Miley Cyrus winding down her TV hit (and about to turn 18 years old), attention has turned to 13-year-old Thorne as the Disney machine’s heiress apparent.

Thorne, who has guested on “Wizards of Waverly Place,” stars in “Shake It Up” as CeCe Jones, an aspiring teenage dancer on a local Chicago dance show. Not coincidentally, Cyrus also balanced school and musical performance on “Hannah.”

Miley Cyrus and Liam Hemsworth have called it quits, Gossip Cop has confirmed.

The couple first broke up back in August. Gossip Cop was the first to report the news.

The pair quickly reconciled.

Days ago, Gossip Cop heard that Cyrus and Hemsworth had split once more, but waited to confirm with more sources.

We’re told there was no dramatic blowout, but that the writing was on the wall for a while.

“These things happen,” our insider says.

Hemsworth has been in his native Australia for the last month. He and Cyrus met on the set of The Last Song in 2009.

Last week, the “Hannah Montana” star’s parents, Billy Ray and Tish Cyrus, announced that they are divorcing.

Miley Cyrus is set to star in an action comedy called So Undercover.

A rep for the singer-actress officially confirmed the news to Gossip Cop.

It had been rumored two months ago, but is now a done deal.

She will play a street-smart private investigator hired by the FBI to go undercover in a sorority.

Tom Vaughan will direct.

Best known as Hannah Montana, Cyrus will also headline the upcoming LOL.

Miley Cyrus‘ parents, Billy Ray and Tish Cyrus, have filed for divorce in Tennessee, citing “irreconcilable differences.”

“As you can imagine, this is a very difficult time for our family. We are trying to work through some personal matters. We appreciate your thoughts and prayers,” they said in a statement to Gossip Cop.

The couple was married for 17 years and have five kids.

Billy Ray is seeking “shared” custody of their three minor children, as well as “equitable distribution of the marital estate.”

Official documents also show a request for a court-approved parenting plan to be signed by both parties.

According to the tab’s online article, “Miley Cyrus is not only back together with boyfriend Liam Hemsworth, they’re headed to the altar.”

“What’s more,” adds the Enquirer, “17-year-old Miley’s proud papa Billy Ray Cyrus is thrilled.”

The tab then quotes an unnamed source as saying, “Billy Ray is all for the wedding… once she turns 18,” which is about a month away.

So when are the nuptials slated to take place?

The Enquirer claims in the spring of 2011.

Hold off on your wedding gifts.

A rep for both Miley and Billy Ray tells Gossip Cop the story is “not true,” and that the “Hannah Montana” star is “not getting married” this spring.

Unfortunately, it’s because she’s getting lots of practice.

Last month, Cyrus was forced to call the police after photographers swarmed her while she drove. Then, two days later, she and Demi Lovato encountered a particularly pesky herd of cameramen after a late dinner.

And now, just this past weekend, the pop star once again had to confront the paparazzi on her tail, driving dangerously through traffic to snap some photos.

After the shutterbugs cut off another motorist, who told Cyrus he planned to call the police, the “Hannah Montana” star walked up to the paparazzi vehicle, pointed out their reckless driving, and asked that they back off.

Given how often Cyrus has to deal with similarly dangerous situations, Gossip Cop thinks she was remarkably calm.

Miley Cyrus shot to fame starring on the family-friendly “Hannah Montana,” but a new music video that shows her in a different light is being blasted as too sexy.

Tim Winter of the Parents Television Council watchdog group is slamming the risque clip for “Who Owns My Heart,” a slick single from Cyrus’ new album, Can’t Be Tamed.

In the video (BELOW), a scantily clad Cyrus is shown waking up in bed before putting on makeup and heading out to a dance party filled with gyrating bodies.

“It is unfortunate that she would participate in such a sexualized video like this one,” says Winter. “It sends messages to her fan base that are diametrically opposed to everything she has done up to this point.”

“Miley built her fame and fortune entirely on the backs of young girls, and it saddens us that she seems so eager to distance herself from that fan base so rapidly.”

This isn’t the first time Cyrus, who was more demure while opening Xandros in Los Angeles last week, has been criticized for playing up her sexuality.

At last year’s Teen Choice Awards, a then-16-year-old Cyrus ignited controversy by performing a pole dance.

HollywoodLife has had trouble distinguishing movies from reality before, so it’s not a total surprise when the site implies that a movie romance must also be happening off screen.

That’s the notion behind the outlet’s latest daydream: Miley Cyrus only reunited with Liam Hemsworth because her LOL co-star Douglas Booth stayed loyal to his girlfriend.

Over the summer, “sources” told HollywoodLife that Cyrus split with Hemsworth “because she was crushing” on Booth.

“But as soon as the movie wrapped on Sept. 7, the Hannah Montana starlet ran back into Liam’s waiting arms,” observes the site.

“Coincidence? We think not,” says HollywoodLife.

Um, actually, we think yes.

Rather than looking at events and offering the (perfectly reasonable) explanation that Cyrus and Hemsworth paired up again after LOL because they could spend more time together and had resolved their differences, HollywoodLife thinks it just means Cyrus failed to break up her co-star’s relationship.

“Although Miley and Liam are solid right now — they’re even living together,” concludes the site, “We can’t wait to see what happens with this love triangle resumes at LOL promotion time!”

A few points.

First, Cyrus and Hemsworth are not living together. Apparently, HollywoodLife not only missed Gossip Cop‘s bust of that rumor, but also video of Cyrus herself debunking it.

Second, there is no “love triangle.” There are two happy relationships — the one between Cyrus and Hemsworth, and the one between Booth and his girlfriend.

Finally, trying to start a controversy for all three stars after acknowledging how “solid” Cyrus and Hemsworth are at the moment is just plain lame.

In other words, HollywoodLife is doing what it does best.

“Wizards of Waverly Place” is coming back.

The Disney Channel ordered a fourth season of the Selena Gomez hit on Thursday, and plans are also in place for a sequel to the sitcom’s hugely popular TV movie.

The fantasy series debuted in 2007, and the August 2009 “Wizards of Waverly Place” movie is the second-highest scripted telecast in the history of cable television, drawing 13.5 million viewers.

The fourth season is the end of the road for another Disney juggernaut, the Miley Cyrus machine “Hannah Montana.”

Miley Cyrus can’t get into the hit show “Glee.”

Even though her song, “The Climb,” was in a recent episode of “Glee,” Cyrus says the popular series is just too unrealistic for her.

“Honestly, musicals? I just can’t. What if this was real life and I was just walking down the street on Rodeo Drive and all of a sudden I just burst into song about how much I love shoes?” says the “Hannah Montana” star in the June issue of Billboard before adding with a laugh, “It would get hits on YouTube.”

The Last Song, starring Cyrus and real-life beau Liam Hemsworth, won the box office in its first day of release, banking an estimated $5.1 million on Wednesday. With the early open, Cyrus topped mid-week performances from major holdovers like How To Train Your Dragon and Hot Tub Time Machine, and is projected to take in as much as $20 million over the holiday weekend.

But its stay at the top may be brief.

Avatar‘s astounding run at #1 is over.

After upsetting the James Cameron juggernaut on Friday, Dear John also posted better Saturday box office numbers, albeit by a narrower margin. The romance earned an estimated $12.4 million yesterday to edge the sci-fi epic’s estimated $11.3 million.

With a weekend total of $32.4 million, Dear John also beat Hannah Montana‘s record for a Super Bowl Weekend. That concert film earned $31.1 million in 2008.

At number two, “Avatar” snagged $23.6 million this weekend, raising its domestic total to $630.1 million.

The weekend is far from over, but early projections have produced a big surprise. The over performing love story Dear John is expected to end Avatar‘s reign atop the box office.

Starring Amanda Seyfried and Channing Tatum, Dear John shot to a huge $13 million Friday opening in North America, far ahead of Avatar, still very strong in its eighth week with a $6 million Friday take.

While numbers from today and tomorrow (Super Bowl Sunday) could obviously shake things up, estimates now place Dear John at roughly $30 million for the weekend, which would be enough to knock off the ridiculously successful Avatar.

Again, numbers won’t be final until tomorrow night. But Avatar‘s long stay atop the weekend box office MAY be over.

It takes a lot to stand out among all the wrong rumors Gossip Cop sees in a week, but this particularly nauseating one fits the bill.

Making the rounds are claims that Noah Cyrus, 9-year-old younger sister to Miley, is – wait for it – launching a children’s lingerie collection.

Ugh.

According to reports, Cyrus and friend Emily Grace Reaves are teaming up to start a lingerie line for a company called Ooh! La, La! Couture. At least that’s what dozens of outlets, including a certain blogger’s celebrity fashion offshoot, all breathlessly announce. We won’t get into the supposed specifics, except to say that it’s all a little unnerving.

And, thankfully, WRONG.

A source close to Cyrus tells Gossip Cop that she is NOT starting this line, that she is NOT involved in its launch, and that it’s NOT lingerie in the first place.

We’re NOT surprised to hear that a sensational rumor took off without anyone checking to see if it was true. Looks like Noah will be devoting her entrepreneurial energies elsewhere.

In a piece classily titled, “Miley Shacks Up With BF,” the National Enquirer breathlessly reports, “Miley Cyrus has a new roommate – her 19-year-old boyfriend!”

According to the supermarket tab, “The 17-year-old Disney tween queen recently moved hunky Australian actor Liam Hemsworth into her family’s Toluca Lake, Calif., home – after informing her parents she’d move out if she didn’t get her away!”

The Enquirer even quotes a so-called “family friend” saying Cyrus’ parents, Billy Ray and Tish, “decided they’d rather have Miley under their roof with Liam than not knowing where she is at night,” so they moved him “into the family guest room.”

Sounds like a very interesting living arrangement.

However, it’s not true. 

A source close to Cyrus tells Gossip Cop that Hemsworth actually lives in West Hollywood with his brother, actor Chris Hemsworth, and another friend.
