A judge ruled Friday that Gabriel Aubry can only have supervised visits with Nahla, his nearly 4-year-old daughter with ex Halle Berry.

The decision follows recommendations from the Los Angeles Department of Children and Family Services to change the former couple’s custody agreement after an investigation into Aubry’s suitability as a caregiver.

Aubry, who was ordered to appear in court today, can no longer see Nahla without supervision from a court-appointed monitor and is no longer entitled to overnight visits, according to reports.

The model’s parenting was most recently called into question last month after Berry’s nanny alleged he assaulted her while Nahla was in her arms.

While the nanny’s request for a restraining order was denied and Aubry isn’t facing criminal charges, he was reportedly ordered to receive anger management.

Aubry and Berry, who split in 2010, have been locked in an occasionally contentious custody battle for more than a year.

UPDATE: Hoskins has since be apprehended by police, and is now being escorted back to the mental facility.

Robert Dewey Hoskins, who was sentenced to 10 years in prison for stalking Madonna and threatening to kill her in the 1990s, has escaped from a mental hospital and remains at large.

In a statement, The Los Angeles Police Department said Hoskins “is a very psychotic man when not taking his medication and has very violent tendencies.”

According to officials, Hoskins simply walked away from the facility, where he’d been placed after a July 2011 arrest for vandalism following his release for the Madonna-related offenses.

In 1996, he was convicted and sentenced to a decade behind bars after scaling a wall around Madonna’s Hollywood Hills residence, claiming that she was supposed to be his wife, and threatening to slit her throat “from ear to ear” if he couldn’t have her.

He was shot twice by security guards.

Even after his incarceration, Hoskins continued to threaten Madonna in prison interviews, and has made similarly violent statements about Halle Berry.

There’s renewed speculation that Halle Berry is engaged to Olivier Martinez in light of reported aspects to her ongoing custody battle with Gabriel Aubry.

Berry is allegedly asking a judge for permission to move to France with her three-year-old daughter Nahla and Martinez.

According to TMZ, an engagement would make Berry’s petition to move out of the country with Nahla stronger in the eyes of the judge.

The site says that she and Martinez became engaged sometime this year, after widespread reports of an engagement made the rounds in December when Berry was spotted with a massive emerald-and-diamond ring from Martinez.

Those rumors were never confirmed.

Gossip Cop has reached out to a rep for the Monster’s Ball actress regarding the revived, custody-related engagement speculation.

Gabriel Aubry will reportedly take anger management classes, following the recommendation of the Los Angeles County Department of Children and Family Services.

On Friday, social workers met with Halle Berry and her baby daddy, following an incident earlier this month in which Aubry allegedly got physical during a confrontation with Berry’s nanny.

During the meeting, Aubry agreed to enroll in a program designed to work on his temper, according to TMZ.

He reportedly maintains that there was no violence with the nanny, however.

The Department of Children and Family Services action will not have any official bearing on the ongoing custody struggle between Berry and Aubry over their daughter, Nahla.

Halle Berry’s nanny Alliance Kamdem was denied her request for a retraining order against Gabriel Aubry in court on Tuesday.

As Gossip Cop reported Monday, Kamdem filed a police report claiming Aubry pushed her into a door as she was holding the former couple’s daughter Nahla during an alleged confrontation last week.

Kamdem, who has since quit her job, said she feared retaliation by Aubry after the incident, but a judge ruled that her petition for a restraining order was insufficient.

In her declaration today, the nanny also claims Aubry pushed her out a door in June, and that he would “violently grab/take Nahla away from me” while Berry was shooting Cloud Atlas in Spain.

The judge said Kamdem’s issues with Aubry should be resolved in family court instead.

The LAPD and child protective services are investigating Aubry for child endangerment and battery after the alleged confrontation with Kamdem.

Gabriel Aubry, the father of Halle Berry’s daughter, is under investigation for child endangerment and battery after an alleged confrontation with Berry’s nanny, Gossip Cop has confirmed.

In a police report, the nanny claims that she went to Aubry’s residence last week to find out why he had kept 3-year-old Nahla at home instead of taking her to school.

Aubry allegedly got angry and cursed at the nanny, pushing her into a door as she held Nahla.

Police are now investigating him for misdemeanor child endangerment and misdemeanor battery.

Child protective services are also investigating Aubry.

Berry herself is not involved at all in the situation.

Halle Berry’s stalker, Richard Franco, who trespassed on her Hollywood Hills property three times in July, has now been sentenced to more than a year in jail.

Franco is set to remain behind bars for 386 days.

In exchange for dropping a burglary charge against Franco, he pled no contest to stalking.

Berry was also granted a 10-year restraining order, which requires Franco to keep a distance of 200 yards.

Franco has already served 193 days of his 386-day sentence.

In her original petition for the order, Berry wrote that she was “extremely frightened” of Franco.

There’s a question as to whether Halle Berry and Olivier Martinez are engaged.

People and Us Weekly both reported that Martinez had popped the question to the Oscar-winning actress over the holidays.

A rep for jewelry designer Gurhan even confirmed to Gossip Cop that he’d purchased Berry an emerald-and-diamond ring.

But now TMZ is throwing cold water on the reports, quoting sources who say the sparkler is “not” an engagement ring.

Gossip Cop is reaching out for comment from Berry’s camp, but so far they’re not talking.

She and Martinez originally met on the set of Dark Tide.

The OMG! celeb site on Yahoo! polled more than 1,000 readers for a Hollywood Holiday Survey – and the results are pretty interesting.

On the question of which male celebrity respondents would most like to smooch on New Year’s Eve, George Clooney tops the list, with 28% of the vote, just beating Johnny Depp (27%).

Ryan Reynolds came in third with 18%, ahead of Brad Pitt and Ryan Gosling, who rounded out the Top 5 with 12% and 7%, respectively.

As for the ladies, 22% of the men polled picked Jennifer Aniston as the number one celeb they’d like to ring in the New Year with a kiss.

Aniston edged out Halle Berry with 18% and Scarlett Johansson with a close 17%.

Angelina Jolie and Megan Fox took fourth and fifth places with 13% and 12%, respectively.

The ugly custody war between Halle Berry and Gabriel Aubry over 3-year-old daughter Nahla appears to be heating up again.

Berry’s lawyer is asking that a judge hold Aubry in contempt for an alleged violation of the former couple’s custody agreement, according to TMZ.

The actress and male model have been mired in a brutal battle over Nahla for months after an amicable resolution proved impossible.

Among other things, it’s been alleged that Aubry called Berry the “N word” and barraged her with vulgar text messages. The contentious custody fight also forced Berry to drop out of Broadway’s “The Mountaintop.”

“That was fast!” begins a piece on Jennifer Lopez in In Touch, which goes on to report that “just two weeks” after the “American Idol” judge announced her split from Marc Anthony, “she’s already got her sights set on another man: Halle Berry‘s gorgeous ex, model Gabriel Aubry.”

According to a so-called “friend,” Lopez “hates being without a man in her life,” and is “looking for a like-minded single dad to date, and Gabriel more than fits the bill.”

The tab adds that Lopez is currently “getting close” to her What to Expect When You’re Expecting co-star Rodrigo Santoro, but is “set on ultimately landing Gabriel.”

Halle Berry has been granted a restraining order against Richard Franco, the man who trespassed on her property three times in one weekend last month.

He’s required to stay at least 100 yards away from the star and her young daughter.

The order lasts for three years.

Franco jumped over the wall of Berry’s Hollywood Hills home twice in July, and was found staring at the actress through her kitchen window.

He’s currently in jail on felony stalking and burglary charges.

In her petition for the order, Berry wrote that she was “extremely frightened” of Franco.

Garry Marshall, the veteran TV and film director who brought us the star-studded film, Valentine’s Day, is back with another big-name ensemble movie, New Year’s Eve.

The plot of the flick revolves around the intermingling of a few couples and singles on December 31 in New York.

Halle Berry’s weekend intruder, who jumped over the wall of her Hollywood Hills home on both Saturday and Sunday — and even stared at the actress through her kitchen window on the second occasion — was arrested on Monday night after trespassing for the third time.

The man, identified as Richard Franco, was spotted and grabbed by Berry’s private security team, who called the police.

The cops quickly responded and arrested Franco, who was booked on suspicion of felony stalking, reports TMZ.

Halle Berry‘s weekend intruder hit her home on both Saturday and Sunday, reportedly staring at the actress through her kitchen window on the second occasion and prompting an LAPD helicopter search.

A man believed to be the same prowler who leaped a wall on her property just a day earlier was spotted by Berry herself yesterday, leading her to call 911, according to TMZ.

Police circled Berry’s house with squad cars and a helicopter but were unable to track down the intruder, who remains unidentified.

The man, who reportedly was seen clutching a book, is believed to be an obsessed fan, possibly determined to get Berry’s autograph.

This is probably not the best way.

Halle Berry had an alleged intruder yesterday.

We’re told an unidentified man scaled over her wall and was spotted on her lawn. When what’s believed to be Berry’s security saw the the alleged intruder, the individual jumped over the wall and ran.

LAPD is currently investigating.

Gossip Cop reached out to her rep, but has yet to hear back.

Oprah Winfrey taped her third and second to last shows on Tuesday night in front of more than 20,000 fans inside Chicago’s United Center.

The first one-hour show was hosted by Tom Hanks, who told the talk-show queen, “Today you are surrounded by nothing but love,” before noting that “pulling off this surprise [filled show] has been a mission impossible.”

Enter Tom Cruise, who Winfrey said “looked like you were 10 when you on my show in 1988.” Cruise has been a guest one dozen times on the show.

Next up was “America’s Got Talent” phenom Jackie Evancho, who sang “Somewhere Over the Rainbow” and was joined by Josh Groban and then Patti LaBelle.

Madonna walked on stage and told Oprah, “You look surprised,” before adding, “Millions of people are inspired by Oprah. I am one of them… She’s a self-made woman who’s been at the top of her game for over 25 years and she is still kicking ass.”

Dakota Fanning came out next to talk about “‘Oprah Show’ Babies,” the generation who grew up watching the program and learning “that girls can run the world.”

That then segued into Beyonce, dressed in a tuxedo leotard, singing her hit, “Run the World (Girls).”

Diane Sawyer was also on hand to announce that 25,000 oak trees are being planted in honor of Oprah, who joked with the audience, “You get a tree, and you get a tree, and you get a tree. Everybody gets a tree!”

Halle Berry, Queen Latifah, and Katie Holmes came out to talk about viewers — who were in the audience — who’ve helped their communities through various charitable acts.

Holmes and Cruise then introduced Rascal Flatts, who closed out the show with a performance of “I Won’t Let You Go.”

The second taped show on Tuesday, slated to the be next to last aired “Oprah Winfrey Show,” was hosted by Will Smith and Jada Pinkett Smith.

And the first guest was former Chicago Bulls legend Michael Jordan, who arrived in the Windy City the same year that Oprah did.

Following the basketball great was Jamie Foxx performing “Isn’t She Lovely.” Foxx was joined on piano by Stevie Wonder, who later sang a song he wrote just for Oprah.

Jerry Seinfeld followed Wonder with a standup routine.

After Simon Cowell made a cameo that included him saying, “You are a very good kisser,” Rosie O’Donnell took the stage to sing, “Fever,” with a number of special Oprah-specific lyrics. Joining O’Donnell onstage were Oprah proteges Dr. Phil, Nate Berkus, and Dr. Oz.

And then — just hours after the shocking revelation that Arnold Schwarzenegger fathered a child out of wedlock – Maria Shriver hit the stage with Gayle King and told Oprah, “For more than 30 years, you bestowed the most amazing friendship on me, given me love, support, wisdom and most of all truth.”

Kristin Chenoweth sang a tune from “Wicked,” which was followed up by a poem Maya Angelou wrote and performed specially for Oprah. Alicia Keys then crooned the song, “Superwoman.”

In a rare public appearance, Stedman Graham took the stage to laud his longtime girlfriend. “I’m so proud of you,” he told his “sweetheart.”

Graham then introduced Aretha Franklin, who belted out “Amazing Grace.”

“I’ve never experienced anything like this,” Oprah told the massive audience, adding, “Thank you for taking me to a place that’s beyond joyous.”

But Will Smith told Oprah there was just one more remaining surprise… Usher, who performed a medley of “O.M.G.” and “Oh Happy Day” before confetti exploded across the audience.

The two taped shows will air on May 23 and May 24. Oprah’s last show is May 25.

Halle Berry has been forced to drop out of her Broadway debut.

The Oscar winner was set to appear in “The Mountaintop,” a fictionalized account of the night before Dr. Martin Luther King Jr.‘s assassination – with Samuel L. Jackson starring as King – but producers of the show said in a statement, “Ms. Berry would not be appearing in the role due to child-custody issues.”

Berry was slated to play a maid at the Lorraine Motel in Memphis, where King was slain on April 4, 1968.

This is not the first time the actress has had to drop out of a part because of the contentious custody battle over her daughter Nahla with former boyfriend Gabriel Aubry.

Back in February, Berry turned over her role in New Year’s Eve to Katherine Heigl because Aubry challenged berry’s right to travel cross-country to New York with Nahla to shoot the film. The court eventually sided with Berry and she took another part in New Year’s Eve.

A judge granted Berry permission to shoot the movie New Year’s Eve in New York – and to take the couple’s daughter Nahla with her.

Aubry had challenged Berry’s cross-country trip with Nahla, but, after hearing arguments from both sides, the court gave Berry the green light.

Halle Berry and Gabriel Aubry‘s bitter custody battle over their young daughter Nahla has now entered even more sensitive territory.

Amid allegations that Aubry (who is white) called Berry the “N word,” Berry discusses Nahla’s racial identity in the new issue of Ebony magazine – and makes a strong statement.

“I feel like she’s black. I’m black and I’m her mother, and I believe in the one-drop theory,” says Berry.

Historically speaking, the “one-drop theory” contends that an individual with even “one drop” of African ancestry should be considered black.

“I’m not going to put a label on it,” continues the actress. “I had to decide for myself and that’s what she’s going to have to decide – how she identifies herself in the world.”

“And I think, largely, that will be based on how the world identifies her. That’s how I identified myself. But I feel like she’s black.”

A toddler’s racial makeup wouldn’t usually be discussed quite so publicly, but as Berry and Aubry’s fight becomes more intense, so too has the focus on Aubry’s personal beliefs.

According to reports, Aubry “went nuts” whenever someone referred to Nahla as “black.”

Halle Berry is gearing up for a battle with Gabriel Aubry over their two-and-a-half year-old daughter, Nahla.

On December 30, Aubry filed court papers seeking joint custody and to be formally recognized as the child’s father.

Now, Berry is fighting back.

“Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her,” her rep tells Gossip Cop.

In fact, Berry has even pulled out of the film New Year’s Eve to focus on the “pending custody litigation involving her daughter,” says the rep.

“She has attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly,” adds Berry’s spokesperson, “but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.”

Halle Berry “is trying to have another baby,” claims In Touch, this time with her new boyfriend Olivier Martinez.

Amidst reports that she’s fighting ex Gabriel Aubry over custody of their daughter, Nahla, Berry is supposedly “forging ahead” with plans for a second child.

“Halle has no plans to marry Olivier, but she really wants another baby, and she thinks that Olivier would be the perfect father,” explains the tabloid’s source, adding that the couple has “already met with an IVF doctor” to explore options.

Chris Brown may have just completed an anger management program, but he sure didn’t show a lot of restraint in a Twitter war today with former B2K band member Raz B.

After Raz B tweeted, “Im just sittin here Thinking how can…@ebenet [Eric Benet] & @ChrisBrown disrespect women as Intelligent as @HalleBerry11 @Rihanna,” Brown immediately fired back with a barrage of tweets riddled with the N-word and gay slurs.

The name calling between the two men continued for several hours, ending with Raz B – who had his share of gay slurs – tweeting at Rihanna, “I see why you not with that Clown.”

Sensing the backlash, Brown later tweeted, “watch me be the bad guy on the blogs tomorrow.”

Producers have announced the first batch of presenters at the 83rd Annual Academy Awards.

Halle Berry, Jeff Bridges, Sandra Bullock, Marisa Tomei and Oprah will be among the big names handing out Oscars.

Bridges and Bullock were last year’s winners in the lead acting categories.

Anne Hathaway and James Franco will host the ceremony on February 27, 2011.

Halle Berry really likes popcorn.

On “The Tonight Show with Jay Leno,” the actress told the host how much she enjoys Garrett Gourmet Popcorn, and brought out a caramel and cheese mix.

Berry’s snacking was “orgasmic,” much to the crowd’s delight.

Perez Hilton, who wrongly claimed in the past year that Halle Berry was pregnant, that Gwen Stefani was expecting, and that Nicole Kidman was having another baby, is now adamant that Jessica Simpson is with child.

In a piece titled, “Jessica Still Looks Preggers,” Perez remarks on a recent photo of Simpson: “A baggy t-shirt, huge purse conveniently situated in front of the belly….We know all the signs!!!”

The blogger, who probably can’t even spell obstetrics, writes, “Jessica Simpson is still keeping quiet about possibly being preggers, but we can’t help but think that an announcement must be coming soon, right?? Right???”

Wrong. Wrong.

As a source close to Simpson assured us a few days ago, the singer-actress is “not pregnant.”

And oh yeah, the New York Post pointed out this morning that a couple of days ago Simpson was at the New York restaurant Stanton Social, where she got her drink on with multiple margaritas and tequila shots.

We’ve said it before, we’ll say it again – the only thing fertile here is Perez’s imagination.
