The man who allegedly attacked “Real Housewives of Beverly Hills” star Lisa Vanderpump’s friend has been charged with felony assault.
Roger Eduardo Talavera is said to have taunted a table that included Vanderpump, her husband Kenneth Todd and friend Robert Kovacik, a Los Angeles TV reporter, at the Polo Lounge at the Beverly Hills Hotel on December 24.

Talavera then allegedly approached the group, punching Kovacik in the mouth and pushing Todd to the ground.

Judge Elden Fox is NOT throwing her in jail.

He is reportedly impressed by her progress but feels that Lohan is an addict.

She nodded at his pronouncement.

“You’re staying past the New Year’s,” said Fox. “There’s a reason for that.”

Judge Fox rejected the district attorney’s desire to send the actress to jail for six months. He reviewed filings from both rehab and probation officials, as well as a letter from Lohan herself.

But here’s the catch: the warrant has been held until Friday morning, meaning if Lohan doesn’t appear in court at 8:30 am on Friday, then she is subject to immediate arrest.

Regardless, Lohan’s probation is considered revoked.

Judge Elden Fox will reportedly issue an order at 8:30 AM Wednesday after an unexpected Monday court appearance by Lohan attorney Shawn Chapman Holley. The order was originally anticipated for Tuesday.

Observers believe that Fox plans to free Lohan from her UCLA rehab stint.
