Sandra Bullock Sues Watch Company for Blind Side Ads

Sandra Bullock has filed a lawsuit tied to her Oscar-winning film The Blind Side.

The actress filed papers in Santa Monica, Ca., against a watchmaker for using her name and image to advertise its timepieces.

According to the lawsuit, “ToyWatch USA intentionally and prominently used Ms. Bullock’s name, photograph, image, identity, and persona in advertising, marketing, and/or promotion… to sell watches.”

The papers state that ToyWatch advertised its pieces as the “Sandra Bullock Watch.”

Basically, they used a photo of Bullock, who wore one of their watches in The Blind Side, to promote and sell that particular model (see photo at right).

But in the court filing, it’s noted Bullock “will not voluntarily appear in print or other media for a company or product unless she carefully selects and believes in the company and product, and unless the compensation she receives is commensurate with the value of the exploitation of her name, image, identity, and persona.”

And the actress says she did not “voluntarily appear” in the ToyWatch USA ads, nor was she compensated for the publicity associated with using her name and image.

Bullock is seeking an injunction to stop the company from further use of her name and likeness, as well as monetary damages.

Looks like the Oscar-winner keep a careful watch on those trying to profit off her.

    Wow kind of agressive of her when she did actually wear their watch, especially for the highest paid actress in the world according to Forbes. Does she need money that badly? Maybe she’s not as rich as they want us all to think. Note to self- do not let Sandra Bullock wear anything you make cuz if anyone mentions it she might go ballistic….

    If she lets them do it then she would have to let everyone. Somewhere down this line i would bet something would go wrong where someone was using her image. Then she would get sucked into it because she didn’t stop them from using her image in the first place.

    It’s a business. She should get paid if she is going to be used for their advertisements. This is just like any one else. She cares about what businesses use her image which I can admire since her name will be associated with the brand.

    Really, you think she was wasn’t justified to be upset over it? I honestly can not believe this company thought that their actions were acceptable. How would you feel if someone used you image to sell something and never thought to ask your permission nor paid you any money for your contribution. When Sandra wore this watch it was a piece of wardrobe from a movie, worn by a character. Really this company is lucky they didn’t get hit with a copy right suit from the company that made the movie as well. If someone ever used my image to sell something that I had not been paid to sell I would sue them as well, it has nothing to do with how much money she makes and everything to do with the fact the watch company should have gotten some legal advise before they did something like this.

    They should stop the company all together. Put them out of business. That company must be mighty dumb to have the least notion that they could exploit her like that without some business transaction involving her and her business end. People would do anything to make money!

    Its a long way from permission to forgiveness and I’ll bet money that Toywatch will say their agreement with the movie makers of “The Blind Side” allowed (or so they thought) using her image from the movie. Meanwhile, though it seems rough for Ms Bullock to react this way we aren’t talking about you or I. We’re talking about someone whose image and name is of great value. Where I her I’d do the same.

    She really has no choice. If she let it slide, at the least, it would set a legal precedent and other business entities could have an argument for doing something similar. Pretty soon, the coffee maker she used in a film, or the car or the soft drink, etc., could be using her image and fame without paying her. Besides, she is a professional person who has work for years to develop her image and become successful. Why should she work for free, because that’s what it amounts to. There are a plethora of other legal and business concerns surrounding this. I say good for her.
