The jury’s still out on this one, and therefore, I’d say GossipCop is taking a big risk by rating it at zero chance of being an authentic picture of Miley Cyrus. You guys may end up with egg on your faces. And just to keep you honest, I’ll appoint myself to follow up on this story and let you know how it turns out. My questions for Gossip Cop are: if this is fake, why did the fakers go to the extraordinary lengths of actually taking the shots in what appears–in great detail–to be an actual room in Madrid’s Westin Palace Hotel, where Cyrus was staying when the picture was allegedly taken? We’ve only seen pictures of Cyrus’ “Just Breathe” tattoo from the side while in a dress, and from the front while in a bathing suit. How do you know that the tattoo is visible in a frontal picture when she’s nude? A bathing suit will naturally give her chest some lift. If I were a betting person, I’d wager that this picture is real, that it is stolen, and that those who are showing it, including Gossip Cop, are risking legal action by publishing a stolen picture that is also a gross violation of privacy. There are only two possibilities, either the picture is authentic and therefore private and should never have been published, or it is fake and therefore should never have been published by Gossip Cop with any mention of Cyrus’ name. Either way, Gossip Cop, you end up playing the same game as the tabloids you are supposed to be policing. You guys get an “F” this time for poor ethics.

Whether it is true or not I hope Gossip Cop gets sued for running this. The truth is out all Gossip Cop really does is spread Gossip but tries to pretend that they have some sort of morals which they don’t.

The fact that Gossip Cop hears legal action is being considered leads me to believe these are fakes. They’re pretty reputable. I’ve read up on the guys who run it – they’re legit journalists, not typical bloggers

Chris, they weren’t the ones who found it and published it. Zack Taylor did. They simply took Taylor’s picture and found out it’s not real. Why blame them? They’re doing a service for us. Also, I’ve been looking online and there’s a guy who photoshopped Selena Gomez’s head on to a nude picture, and he’s taken other people’s shots and done the same. A lot of people online are pretty sure this guy was responsible for this photo.

Or maybe the reason you can’t see her tattoo is that this photo was taken using a mirror, which means her tattoo (located under her left breast) is under the “tastefully” draped hair on her boob, which appears to be the right side of her body, but is really the left, due to the mirror. Perhaps that’s why the hair is placed just so, to prevent identification.

When you see the full photo, which has been cropped on this site, the part that is being obscured by the inset photo of miley in the photo above, you can see the edge of the mirror where it meets another pane of glass. @GossipGirl, I don’t want to call you naive because I don’t know you. I’m sure your heart is in the right place, but I would urge you to savvy up a bit. There were many sites that reported on this story without publishing these pictures, which were either stolen or faked, making it wrong to publish them, especially the nude one. Even Perez Hilton did not publish any of these pictures. Maybe he’s learned his lesson? Or maybe he knows that he does not own these pictures or have license to publish them. There was no good reason for Gossip Cop to publish these pictures either, other than that they knew more people would come to their site if they did. Now, I’d like to know who Gossip Cop paid to publish the picture they published. Did they pay Zack Taylor, who published two totally contradictory stories on the subject yesterday? Or did they not pay anyone? Did they violate someone’s copyright, and if so, whose? Who do the pictures belong to and were they stolen or were they faked. If the pictures were Miley Cyrus’ then she owns the copyright and Gossip Cop and hundreds of other publications violated her copyright. If they are fakes, they whoever did it is making an illegal use of Miley Cyrus’ image and the pictures are still not legal to publish. Either way, Gossip Cop comes off looking just as unethical as the sites they pretend to police.

Congratulations, Chris. In the process of beating up on GossipGirl, who for all we know could be just a young woman, you’ve actually defamed GossipCop and what you said is easily actionable. Clearly, you are not an attorney – or as knowledgeable as you think.

First off, I have no legal affiliation to GossipCop, but I do know my law in “fair using.”

Gossip Cop did a screenshot of another site, as one is 100% allowed within the law for purposes of commentary. It’s generally accepted that if one were to comment on a picture or story, one would SHOW the story in question. That’s obvious, though apparently not to you.

By doing so, they did not violate anyone’s copyright.

And by noting that the picture in question is fake, they’ve established that the picture does NOT belong to Cyrus. How can Cyrus’ mark be violated if it isn’t a photo of her?

Actually, the only questionable info on this entire page are your seeming defamatory statements. You write, “I’d like to know who Gossip Cop paid to publish the picture they published.”

Firstly, this defies logic. Why would Gossip Cop pay a third party to publish a picture that they, in turn, then deem to be a fake.

More importantly, you are alleging that they got paid to manufacture a photo, which axiomatically they did not.

Equally illogical is your contention, “Did they pay Zack Taylor, who published two totally contradictory stories on the subject yesterday?” Why would Gossip Cop pay another blogger to get a story wrong?

That’s preposterous.

In fact, a quick search on their engine shows they have on a several occasions corrected Zack Taylor for being inaccurate.

That said, you should first apologize to GossipGirl for your remarks.

And perhaps of more concern, you should be careful because, based on your seemingly libelous comment, GossipCop – which didn’t violate anyone’s mark and fair used a (manufactured) photo – can easily sue you.

You certainly owe them an apology, too.
