Madonna Sued Over her new Material Girl Clothing Line

Just weeks after Madonna debuted her “Material Girl” clothing line, a fashion company claims the singer infringed on its trademark – and wants her to pay for it.

L.A. Triumph, Inc. has filed a lawsuit against Madonna and her company for using the name “Material Girl,” which L.A. Triumph says it has used to market its clothing for more than 10 years.

According to the lawsuit, L.A. Triumph not only wants a judge to declare that Madonna’s new fashion line demonstrates marketplace “deception,” but also wants to be paid all of the profits being generated from the singer’s similarly named clothing line.

    This is how trademark works. Prior use of a trademark in the course of trade or commerce, particularly long term use gives the prior user common law trademark rights over the goods and services it trades in. In this case there are a couple of companies that have been engaged in long term use of the name, one in Canada, and the LA Triumph Inc company. The Canadian company has also had a registered trademark in the name and is suing Madonna in a Minnesota Court. Although Madonna is associated with the song Material Girl, trademark law requires her to have used the name in trade or commerce to sell products or merchandise. Copyright over the song and trademark are two different rights which perform two different functions.
