Lindsay Lohan NOT Going to Jail; Sent to Rehab Til Next Year

Lindsay Lohan has to stay in rehab until January 3, a court has ruled in today’s probation violation hearing.

Judge Elden Fox is NOT throwing her in jail.

He is reportedly impressed by her progress but feels that Lohan is an addict.

She nodded at his pronouncement.

“You’re staying past the New Year’s,” said Fox. “There’s a reason for that.”

Judge Fox rejected the district attorney’s desire to send the actress to jail for six months. He reviewed filings from both rehab and probation officials, as well as a letter from Lohan herself.

She cried in relief when the decision was made.

Lohan will have her SCRAM bracelet removed.

She will remain randomly tested for drugs and alcohol through her probationary period.

Michael Lohan and Dina Lohan were both in the courtroom for the hearing.

Lindsay has to report back to court on February 25.

It’s the latest chapter in a twisting saga that spanned the entire summer.

The terms of Lohan’s previous probation were set in late May, at which point she was forced to wear a SCRAM alcohol monitoring bracelet.

Judge Marsha Revel sentenced a stunned Lohan to 90 days in jail on July 6 for not completing her court-mandated alcohol education classes.

The star surrendered to authorities and entered jail on July 20.

On August 2, Lohan was released from jail early, leaving for a rehab stint at the UCLA Medical Center.

Just over three weeks later, Lohan left rehab after medical professionals said she was “misdiagnosed.”

But not long after, Lohan failed a drug test, violating the terms of her probation and setting today’s proceedings into motion.

The actress was ordered to jail (again) on September 24 to await today’s hearing and initially denied bail, to her camp’s surprise. That decision was reversed hours later, allowing her to go free.

Lohan entered rehab at the Betty Ford Center on September 28 — the fifth time she’s been in such a facility. Contrary to reports that she tried to escape, Gossip Cop is told she had been attending AA meetings and helping other patients.
