UPDATE – 9/24/10 – 9:20 pm

Lindsay Lohan will be a free woman after all.

An appeals court has reversed Judge Elden Fox‘s decision to deny the star bail, determining that it violated California law, which gives misdemeanor defendants the right to post bail.

Judge Patricia Schnegg overruled Judge Fox, setting bail for Lohan at $300,000.

The actress is expected to post the sum shortly.

Under the terms of her (potential) bail release from Lynwood Correctional Facility, Lohan would reportedly be required to get (her third) SCRAM bracelet, cannot associate with known drug users, and must submit to random search by law enforcement.

Gossip Cop will monitor developments…

ORIGINAL POST – 6:06 pm -

Lindsay Lohan isn’t going without a fight.

Her legal team filed an appeal to Judge Elden Fox‘s decision earlier today, which resulted in Lohan being led from the courtroom in handcuffs and taken to Lynwood Correctional Facility without the possibility of bail.

The filing was on the grounds that Judge Fox didn’t have the right in the first place to hold Lohan without bail.

A couple of hours ago, the jailed starlet’s lawyer, Shawn Chapman Holley, briefly met with the judge in his chambers and reportedly requested that the judge set bail for Lohan so that she can go free until a probation violation hearing on October 22. But the judge didn’t budge.

The actress was brought before Judge Fox earlier today after recently failing a drug test, thereby violating a term of her probation.

Gossip Cop will update as more details emerge.

or a neverending probation, or for a heart attack due the law uncertainity, or by commiting suicide reading comments about her, or crushed by a paparatzzi stampede.
    The posibilities are endless!

When someone violates probation and is ordered to serve time, there should be NO BAIL permitted. Lindsay was convicted of a misdemeanor earlier, however, violating probation should be an entirely different issue. The laws in California suck in my estimation.
Money and celebrity status is more important. Lindsay is a menace to herself right now, and a danger to everyone else. Maybe the next judge will be harsher with someone else if Lindsay injures or kills someone this time while out.

manly, she was sent to the jail to wait for the hearing when she WILL BE SENT 30 DAYS to the jail.
If she doesn’t do 30 days will be due overcrowding not by her influence.
And , yes, the laws in California suck .

i give up on the laws…seriously, i do…if she can get away with it here…then all celebs will…

It just may be right that our collective hero was dealt a harsh hand, or the slight of a judge who was presumably too eager to deal with Lilo in a way that suggests “party favors and 8 inch Louboutins aside’ the court always knows best.

Bail is designed to guarantee the appearance of a defendant in court at the time the judge directs.
