Brian Austin Green Loses $200,000 Lawsuit Against Ex-Girlfriend Vanessa Marcil

Brian Austin Green, who welcomed son Noah last month with his wife Megan Fox, has lost a hefty lawsuit against his ex-girlfriend and baby mama.

As Gossip Cop previously reported, Green sued former “Beverly Hills 90210″ co-star Vanessa Marcil earlier this year over what he claimed was a $200,000 loan that she allegedly never repaid.

Green claimed he first loaned Marcil — the mother of his 10-year-old son Kassius – $50,000 back in 2000.

The actor also said he gave her an additional $150,000 with the understanding that she would re-pay him at a later date.

When Green asked her to pay up last November, Marcil allegedly refused, prompting him to sue her for the money, plus damages.

But now a judge has ruled that Green isn’t entitled to the cash, determining that the statute of limitations has expired.

But it gets worse for him.

The judge also said that Marcil can now countersue for damages incurred by what her attorneys labeled a “frivolous” lawsuit.

Marcil is reportedly seeking at least $50,000.

If they want to raise a screwed up child, they are well on their way. Parents who would rather fight than love their children, how classy.

Why isnt that considered child support, she shouldn’t have to pay it back.

How do you know he doesn’t also pay child support on top of that money?

they never said it was child support, so dont start rumors :P

Child support was never discussed and never brought up. This was a loan. The judge was right about the statute of limitations. Depending on the state you live in you have 2 – 5 years to try to recoup your money.

I loaned by bro $3000.00 and he has refused to pay. He begged for the money with the promise to pay but then said he did not think he owed because we are related. He sold land and got $30,000 and still refused to pay. He just got a settlement of $50,000 — and still refuses to pay. And I’m a single mother that gets no child support. When you borrow money from someone with the PROMISE to pay it back — and then don’t — it’s stealing. You lied to them to get the money. It’s stealing — cut & dried.

Let this be a lesson to anyone — if someone borrows money — be it relative or friend — get something in writing. Something that they sign and date. If they stop trying to pay you back then take action — don’t wait for them to get a conscience. If Marcil turns around and files seeking additional funds — when she KNOWS she borrowed the money — then that says a lot about her character.

You can get back child support from their social security checks. Someone I know did.

Abbeysbooks, did you read the story or D. Martin’s comment? Both clearly state the money was intended to be a loan, not child support. That’s why the statute of limitations comes into play.

I agree with you in principle but don’t have an opinion one way or the other on this case. The judge never ruled on the issue of whether the money was in fact a loan. His rulings was merely on the statute of limitations expired so whether it was a loan or not was irrelevant and therefore no need for him to rule on that. I won’t judge Vanessa if she does countersue because I really don’t know the facts of what happened or her side of the story.

She mentioned she was a single mother not getting child support. That’s why I said it. I read carefully.
