“The Situation” Demands Abercrombie & Fitch Stop Exploiting Him

The Situation (Mike Sorrentino) has launched a legal assault on Abercrombie & Fitch, with the “Jersey Shore” star claiming the clothes company is profiting off his name without permission.

Last month, A&F reportedly offered The Situation a “substantial payment” to stop wearing the brand, citing concerns over “significant damage” to the clothing’s image.

Now, Sitch is fighting back, insisting that Abercrombie stop selling shirts inspired by his name and slogans, including garments that read “The Fitchuation” and “GTL Fitch” (“GTL” being the well-known “Jersey Shore” abbreviation for “Gym Tan Laundry.”)

Lawyers for the fab-abbed personality have sent Abercrombie a cease-and-desist letter demanding that the shirts be pulled from shelves, and alleging that they infringe on The Situation’s legal copyright.

The “Jersey Shore” star’s camp argues that he should be paid for the permission violation, and also charges that the supposed August offer to stop wearing the brand was nothing more than a publicity stunt designed to exploit him even more.

    That’s what I was wondering. If he hasn’t had these words copy written then they’re fair game and he has no case. Just because you always say something, it doesn’t mean you now own them & no one else can use them.

    He does have some legal validity in this case. Copyright isn’t as specific as you think. These slogas that Abercombie are using have been said by the Situation and recorded in a fixed medium. Therefore, they are copyrighted. Abercombie does need his permission to use them as well as any variation on it. Just saying… a little enlightenment for you.

    Um…okay. I’ve never watched Jersey Shore but I’m pretty sure that this guy – whoever he is – heard that phrase somewhere and he is now using it. Also, is this guys only claim to fame is a reality show and showing his stomach all the time?

    For things to be copyrighted, they need to display some creativity. When authors write books, they use words, phrases and such that have been said long before these authors decided to record them in the form of a book. Why do they get to copyright their stuff? Because they use the words/phrases in a creative way. They show some originality. The same can be said of The Situation. He created a brand. The Situation-type products wouldn’t be valuable had he not made it popular. Abercrombie is using the brand he created, therefore he deserves compensation. Read some, okay? It’s okay to be a nerd. Nerd’s are the new gangsta.

    But A & F is a virus that cannot be stopped.
    I loathe that show, Jersey Shore.
    But I loathe A & F so much more.
